Having a prince kill a noble when a beat-down would do would cause big problems. You’d have pro-war nobles using this as justification for having started the war in the first place. Add to that the fact that his brother would certainly know about this and use it against him in their own fight for power in his own home country… yeah, killing the guy would cause issues.
